Miami-dade jury finds for philip morris usa in an engle trial
Richmond, va.--(business wire)--marking the ninth win for the company in the last 13 engle cases to go to trial, a miami-dade jury today decided in favor of philip morris usa and another tobacco company (junious). "this jury appropriately rejected the plaintiff’s claims and instead held her responsible for her own smoking decisions," said murray garnick, altria client services senior vice president and associate general counsel, speaking on behalf of philip morris usa. "despite this and other recent wins, we continue to believe that the engle trial structure is fundamentally unfair and unconstitutional.” today's verdict came in a trial of a so-called engle progeny case following a 2006 florida supreme court decision that decertified a class action but allowed former class action members to file individual lawsuits and rely on general findings from the first class action. “this is the first engle case to be tried by the company following a september 4th district court of appeals decision which questioned the constitutionality of the engle trial structure,” garnick noted. today's decision came in junious v. rj reynolds et al, case number: 07 23586 ca 04.
